Algemene Voorwaarden – ADT Chauffeur Service Amsterdam - Terms and Conditions (2026)
1. Definitions
• Service Provider: ADT CHAUFFEUR SERVICE AMSTERDAM, registered with the Dutch Chamber of Commerce under number 77076397.
• Customer: Any natural person or legal entity using the services of ADT CHAUFFEUR SERVICE AMSTERDAM.
• Services: All chauffeur, private driver, executive transport, and passenger transportation services offered by ADT CHAUFFEUR SERVICE AMSTERDAM, including airport transfers, city rides, and hourly chauffeur services.

2. Applicability
These general terms and conditions apply to all quotations, reservations, rides, agreements, and other legal relationships between ADT CHAUFFEUR SERVICE AMSTERDAM and the customer. Deviations are only valid if agreed upon in writing.
ADT operates as an online reservation and mediation platform facilitating reservations between customers and independent drivers and/or partner transport companies.
When a reservation is made through ADT, the agreement for the actual transport service is concluded directly between the customer and the relevant driver or partner company.
In such cases, ADT CHAUFFEUR SERVICE AMSTERDAM is not a party to the passenger transport agreement and accepts no liability for damages, delays, accidents, deficiencies, or other consequences arising from the execution of the ride by third parties.
ADT remains solely responsible for the proper functioning of the platform, reservation system, and, where applicable, the processing of payments.
Complaints relating to the execution of the ride by third parties must be addressed directly to the relevant driver or partner company. ADT may mediate but is not obliged to provide compensation.

3. Intellectual Property
• All intellectual property rights relating to the website, texts, photographs, and other materials belong to ADT CHAUFFEUR SERVICE AMSTERDAM.
• Without prior written consent, it is not permitted to copy, distribute, use, or misuse materials belonging to ADT CHAUFFEUR SERVICE AMSTERDAM.

4. Reservations and Prices
• All prices displayed online are prepared as carefully as possible. Obvious errors (such as typographical or programming errors) do not entitle the customer to performance of the agreement.
• Online rates may be adjusted at any time without prior notice.
• For online reservations, the rates displayed on the website apply. For telephone bookings, meter rates or pre-agreed fixed rates apply.
• ADT CHAUFFEUR SERVICE AMSTERDAM applies a minimum fare of €37.50 for passenger cars and €78 for minivans for telephone and app bookings, regardless of the metered fare.

5. Payment
• Payment must be made in advance or immediately after completion of the ride, via the available payment methods.
• Service fees may be charged for credit card payments.
• If a customer initiates a chargeback (credit card reversal), ADT CHAUFFEUR SERVICE AMSTERDAM reserves the right to recover the full ride price plus administrative and collection costs.
• To protect the privacy of business clients, ADT CHAUFFEUR SERVICE AMSTERDAM is not obliged to provide GPS data or other sensitive information to third parties.

6. Cancellation by the Customer
• In case of cancellation within 48 hours before the start of the ride, no refund will be issued.
• In case of cancellation more than 48 hours before the start, the ride price will be refunded minus 3% transaction costs.
• Refunds will only be made via the same payment method used for the reservation. ADT CHAUFFEUR SERVICE AMSTERDAM is not liable for additional costs or delays caused by banks or credit card companies.

7. Cancellation by ADT CHAUFFEUR SERVICE AMSTERDAM
ADT CHAUFFEUR SERVICE AMSTERDAM reserves the right to cancel reservations in case of:
• unforeseen circumstances
• force majeure
• insufficient availability of vehicles or drivers
In such cases, the paid ride price will be fully refunded. The customer is not entitled to additional compensation.

8.1 No-shows, Waiting Time and Complaints
• If a driver does not appear or the agreed service is, in the customer’s opinion, not properly executed, the customer must notify ADT CHAUFFEUR SERVICE AMSTERDAM in writing by email within twelve (12) hours after the scheduled start time of the ride.
• The notification must include sufficient proof of contact attempts and supporting documentation (such as photos or messages).
• Failure to report in time or provide sufficient evidence results in forfeiture of any right to refund or compensation.
Complaints submitted later will not be processed and do not entitle the customer to a refund.

8.2 Execution of the Service and Proof for Chauffeur Services
The agreed duration of a reservation applies to the total period during which the driver is available to the customer, regardless of whether the customer fully utilizes the booked time.
Non-use does not entitle the customer to a refund or discount.
The service is deemed properly performed if the driver was present in accordance with the reservation and available during the booked period.
Complaints must be submitted in writing by email within twelve (12) hours after the scheduled end of the ride, including evidence.
Failure to submit a timely complaint with evidence results in the service being irrevocably deemed correctly performed.
In case of a chargeback, the customer remains fully liable for the agreed ride price plus all additional costs incurred by ADT CHAUFFEUR SERVICE AMSTERDAM (administrative, legal, and collection costs).
Only written communication via email or WhatsApp is considered valid proof regarding execution of reservations and agreements.
Telephone agreements or verbal commitments without written confirmation are not binding.

8.3 City Rides and Airport Transfers
City Rides
• 10 minutes waiting time included from scheduled pick-up time.
• If waiting exceeds 10 minutes, waiting time will be charged from the scheduled pick-up time.
• If the customer is not present within 25 minutes, it is considered a no-show and 100% of the ride price will be charged.
• Additional waiting time may be charged if the driver waits longer.

Airport Transfers
• 60 minutes waiting time included from official flight landing time.
• Waiting exceeding 60 minutes will be charged at the applicable rate.
• If the passenger does not appear within 90 minutes, it is considered a no-show and 100% of the ride price will be charged.
• Waiting time caused by the customer will be charged by the vehicles hourly rate which can be found on the homepage.

9.1 Additional Costs
Only luggage that fits easily in the vehicle’s luggage compartment is permitted.
Large items such as:
• bicycles
• furniture
• bulky goods
are not allowed unless agreed in writing beforehand.
If transport becomes impossible due to such goods, ADT CHAUFFEUR SERVICE AMSTERDAM may refuse the ride without refund.
Additional costs during the ride (tolls, parking, ferries etc.) are always at the customer’s expense unless agreed otherwise.
Vehicle contamination or damage may result in a cleaning fee of €350.

9.2 Hourly Chauffeur Services
A minimum booking duration applies for chauffeur services and private tours.
• Hours are calculated from the agreed start time.
• Unused hours are non-refundable.
• Maximum 20 km per booked hour included.
• Additional kilometers will be charged by vehicles distance fee which can be found on the websites homepage
Hourly bookings start and end in Amsterdam unless agreed otherwise.

9.3 Lost and Found
ADT CHAUFFEUR SERVICE AMSTERDAM is not liable for lost or forgotten belongings.
Found items are stored for 30 days.
Shipping or collection costs are paid by the customer.

9.4 Exclusivity and Direct Booking Prohibition
Customers are not allowed to directly book drivers working through ADT outside of the platform.
Violation results in a penalty of €1,500 per violation, without prejudice to the right to claim additional damages.

9.5 Transfer of Rides
ADT CHAUFFEUR SERVICE AMSTERDAM reserves the right to have a ride performed by another driver, vehicle, or affiliated transport company.
Equivalent service must be delivered.

9.6 Conduct in the Vehicle
Passengers must behave respectfully.
Prohibited:
• smoking
• alcohol abuse
• drugs
• aggressive behaviour
• vehicle damage
The driver may terminate the ride immediately without refund.

9.7 Right to Refuse Customers
Drivers may refuse service if transport is unsafe due to:
• intoxication
• aggression
• nuisance
• exceeding passenger or luggage limits
No refund will be granted.

9.8 Business Accounts
Private customers: payment in advance
Business customers with account: 14 days payment term
Late payments may incur statutory commercial interest and collection costs.

10. Liability
ADT CHAUFFEUR SERVICE AMSTERDAM is not liable for indirect or consequential damages, except in cases of intent or gross negligence.
ADT is not liable for delays caused by:
• traffic
• road closures
• weather conditions
• external circumstances

11. Force Majeure
In case of force majeure such as:
• driver illness
• breakdowns
• extreme weather
• strikes
ADT CHAUFFEUR SERVICE AMSTERDAM is not obliged to perform the agreement and is not liable for damages.

12. Amendments
ADT CHAUFFEUR SERVICE AMSTERDAM reserves the right to amend these terms.
The latest version is always available on the website.

13. Governing Law
All agreements are governed by Dutch law.
Disputes will be submitted to the competent court in the Netherlands where ADT CHAUFFEUR SERVICE AMSTERDAM is established.

14. Privacy and Data Protection
ADT CHAUFFEUR SERVICE AMSTERDAM processes personal data only for the execution of services and in accordance with applicable privacy laws (GDPR).
Personal data will not be shared with third parties unless legally required.
To protect the privacy of business clients, GPS data and other sensitive information will not be shared with third parties.

Availability of chauffeur services, vehicles, or specific resources may depend on availability, planning, traffic conditions, and arrangements with independent drivers or transport partners.

In this Privacy Statement, we explain which personal data we collect, for what purposes, on which legal bases, how long we retain data, with whom we share data, and what rights you have. Under the GDPR, organisations must provide this information in a clear and understandable way.
1. Scope of this Privacy Statement
This Privacy Statement applies to all personal data processed by ADT Chauffeur Service Amsterdam in connection with its website, booking requests, chauffeur services, customer support, invoicing, and other related services.

2. Who is responsible for the processing?
ADT Chauffeur Service Amsterdam is the controller for the processing of personal data described in this Privacy Statement, insofar as it determines the purposes and means of the processing. Where third-party service providers process personal data on our behalf, they act as processors and are bound by appropriate contractual arrangements. The distinction between controller and processor is a core requirement under the GDPR.
3. Which personal data we process
Depending on the service requested, ADT Chauffeur Service Amsterdam may process the following categories of personal data:
• identification and contact details, such as name, address, email address, telephone number, company name, and billing details;
• booking and transport details, such as pick-up and drop-off locations, date and time of travel, flight number where relevant, passenger name, special instructions, and communication concerning a booking;
• payment and invoicing data, such as payment status, invoice data, VAT-related information, and limited transaction details from payment providers;
• account or login details, if a customer account is offered;
• customer service data, such as questions, complaints, feedback, WhatsApp or email correspondence, and call-related notes where necessary;
• technical and website usage data, such as IP address, browser type, device information, pages visited, and cookie-related preferences, where applicable;
• any other information that you voluntarily provide to us in connection with our services.
Under the GDPR, personal data must be adequate, relevant and limited to what is necessary for the purpose for which it is processed.
4. How we collect personal data
We collect personal data:
• directly from you, for example when you submit a booking request, contact us, request a quote, make a payment, or communicate with us by phone, email, WhatsApp, or website forms;

• from third parties where necessary for the performance of a booking or service, such as payment providers, business clients making a reservation on your behalf, or transport partners involved in the execution of the service.

5. Purposes of processing and legal bases
ADT Chauffeur Service Amsterdam processes personal data only where there is a valid legal basis under Article 6 GDPR. Relevant legal bases include performance of a contract, taking steps prior to entering into a contract, compliance with a legal obligation, consent where required, and legitimate interests where those interests are not overridden by your rights and freedoms. The EDPB and EU guidance stress that the correct legal basis must be identified for each processing activity.

a. To handle bookings and perform transport services
This includes quotations, reservations, dispatching drivers, coordinating pick-up and drop-off, customer contact regarding the ride, and handling changes or cancellations. The legal basis is usually performance of a contract or taking steps prior to entering into a contract.
b. To manage payments, invoices, and administration
This includes processing payments, issuing invoices, maintaining financial records, and dealing with chargebacks or collection processes where necessary. The legal basis is performance of a contract and, where applicable, compliance with a legal obligation under tax and accounting rules.
c. To provide customer support and respond to questions or complaints
When you contact us, we use your data to respond and to document the request. The legal basis is generally performance of a contract, pre-contractual steps, or legitimate interest in maintaining proper customer service.
d. To improve our website, services, and operational security
We may use technical and usage data to maintain our systems, prevent abuse, secure our website, and improve service quality. The legal basis is generally legitimate interest, provided an appropriate balancing test supports that use.
e. To comply with legal obligations
We may process personal data where necessary to comply with obligations under applicable law, including tax, accounting, fraud prevention, lawful requests from authorities, or record-keeping duties. The legal basis is compliance with a legal obligation.
f. For direct marketing, only where permitted

6. Sharing of personal data

• drivers, subcontractors, or transport partners involved in carrying out the booked service;
• payment service providers and banks for payment handling;
• IT, hosting, website, communication, and software providers acting on our behalf;
• accountants, legal advisers, debt collection providers, or insurers where necessary;
• public authorities or supervisory bodies where disclosure is required by law.
Where third parties process personal data on our behalf, we conclude data processing agreements where required. Personal data is not sold to third parties. The GDPR requires appropriate safeguards and arrangements when processors are engaged.
7. International transfers
If personal data is transferred outside the European Economic Area, ADT Chauffeur Service Amsterdam will ensure that such transfer is based on a valid transfer mechanism under the GDPR, such as an adequacy decision or appropriate safeguards including standard contractual clauses, where required. 8. Retention periods

• booking and customer communication data are retained as long as reasonably necessary for service delivery and complaint handling;

• marketing consent records or unsubscribe records may be retained as necessary to demonstrate compliance;
• technical logs are retained for a limited period, unless longer retention is needed for security or incident investigation.
The GDPR requires storage limitation: data may not be kept longer than necessary for the stated purpose.

• request restriction of processing in certain circumstances;
• object to processing based on legitimate interests, including direct marketing;
• receive your data in a portable format where the legal conditions are met;
• withdraw your consent at any time where processing is based on consent.
These rights are not absolute and may depend on the specific legal basis and circumstances of the processing. Organisations must generally respond to a request within one month.

11. Complaints
If you have a complaint about how ADT Chauffeur Service Amsterdam processes your personal data, please contact us first so we can try to resolve it. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens). The AP is the competent supervisory authority in the Netherlands for GDPR-related complaints.
